CONSULAR SECTION SOLEMNIZATION OF MARRIAGE AND ISSUANCE OF CERTIFICATE OF LEGAL CAPACITY TO CONTRACT MARRIAGE

Article 75 and Article 10 of the Family Code of the Philippines provide that marriage may be solemnized abroad by a consular officer (i.e., a Consul-General, Consul or Vice-Consul) when the marriage is between Filipino citizens, male and female. The consular officer shall perform the issuance of the Certificate of Legal Capacity to Contract Marriage (CLCCM) and the duties of the local civil registrar and of the solemnizing officer, with regard to the celebration of the marriage.

The requirements are: 

  1. Both parties are required to appear in person before the consular officer at the Embassy to apply for CLCCM;
  • If one/ both of the contracting parties is/ are between 18 to 21 years old, an “Affidavit of Consent” executed by the parents of the contracting parties should be presented to the consular officer.
  • If one/ both of the contracting parties is/ are between 21-25 years old, a written proof of Parental Advice should be presented to the consular officer.
  1. Duly authenticated Certificate of "No Record of Previous Marriage," issued by the National Statistics Office (NSO) and duly authenticated by the Department of Foreign Affairs (DFA);
  1. Duly authenticated “Certificate of Live Birth,” duly authenticated by NSO and DFA;
  1. Photocopy of first page of Philippine passports where applicants’ photograph and personal particulars are indicated; and,
  1. Two witnesses above 21 years old, preferably a male and a female to be present during the solemnization of marriage.

Note: After submission of the required documents, a ten (10) day publication of "The Intent to Marry" by both parties shall be posted at the Embassy.

If there are no objections received and upon payment of the processing fee (Bt 1,125.00), the solemnization of marriage will be performed within the Embassy premises by the consular officer on a scheduled date, usually on a working day, mutually convenient to the contracting parties and the solemnizing officer. Contracting parties as well as their guests are requested to arrive at the Embassy in semi-formal or formal attire.
